Terms of use
These terms govern your use of QwikPlot. By creating an account or using the platform, you agree to them. Please read them, and if you do not agree, do not use the service.
What QwikPlot is
QwikPlot provides software that estates, brokerages and developers use to list and sell land, and that buyers use to find and purchase it. We provide the platform. We do not own the land sold through it, and we are not a party to the sale agreement between a buyer and the operator selling to them.
Your account
You are responsible for the accuracy of the information you give us and for keeping your login details secure. Tell us promptly if you believe your account has been used without your permission.
If you sell land
If you sell land through QwikPlot, you are responsible for the legitimacy of that land and your right to sell it, for the accuracy of your listings and pricing, and for honouring the agreements you enter into with buyers. QwikPlot gives you the tools to run the sale. It does not stand behind the underlying land or title.
If you buy land
Bookings, fees, deposits and payment plans are set by the operator selling the parcel, and your purchase is an agreement between you and that operator. We give you a clear and complete record of it, but the obligations of the sale run between you and them.
Payments and fees
Payments are processed through Stripe and Paynow. Booking fees, administration fees, deposits and instalments are determined by the operator. Refunds, where they apply, are handled by the operator according to the terms of your sale, since that money is theirs and not ours.
Documents and title
QwikPlot generates documents such as the Agreement of Sale, receipts, statements and the clearance letter from the live record of your purchase. These are an accurate record of what has happened on the platform. They are not, on their own, registered title. Title to land is obtained through the official registry and the conveyancing process, and a clearance letter confirms that your obligations are met rather than transferring the deed.
Registries and conveyancers
QwikPlot is designed to work alongside official registries and the conveyancers who handle transfer. We are not responsible for the decisions, accuracy or timing of those external bodies, and connecting to a registry does not make us responsible for what that registry records.
Acceptable use
Do not use QwikPlot to break the law, to defraud anyone, to upload content you have no right to, or to interfere with the security or operation of the platform.
Our platform
The QwikPlot platform, its software, design and brand belong to us. Using the service does not give you any right to them beyond the right to use the service as it is intended.
Disclaimers and liability
We work hard to keep QwikPlot accurate and available, but the platform is provided as it is, and we do not guarantee that external registries are correct, that a particular sale will complete, or that the service will be uninterrupted. To the extent the law allows, QwikPlot is not liable for losses arising from the underlying land or title, from the conduct of an operator or a buyer, or from the actions of external registries or conveyancers. Our role is the platform, and our responsibility is limited accordingly.
Governing law
These terms are governed by the laws of Zimbabwe, and any dispute connected to them falls under the jurisdiction of the Zimbabwean courts.
Changes
We may update these terms as the platform grows. When we make a material change we will update the date above, and your continued use of QwikPlot means you accept the updated terms.
